Terms of Use

The short version: Zenithal is a hobby tracker. Your records are yours and live on your device; keeping a backup is your responsibility. Pro is a one-time purchase, not a subscription.

1. Agreement to these terms

By downloading or using Zenithal (“the app”) you agree to these terms. If you do not agree with them, please do not use the app. The app is published by Trueframe Digital.

2. Licence

We grant you a personal, non-exclusive, non-transferable licence to use Zenithal on devices you own or control, in line with the rules of the store you obtained it from. You may not resell, redistribute, rent out, decompile or reverse-engineer the app except where the law expressly allows it.

3. Your data is yours

Everything you save stays on your device. We do not hold a copy and we cannot recover it for you. Backup, restore and CSV export are free and always available in the app, and keeping a backup is your responsibility; a lost, wiped, broken or stolen device means the records on it are gone. 4. Zenithal Pro & purchases

The app is free to use, and the free tier is not a trial and does not expire. Zenithal Pro is optional and is sold as a one-time purchase that unlocks the Pro features described on the purchase screen. It is not a subscription, it does not renew and it does not expire.

Purchases are processed by the Apple App Store or Google Play and are governed by that store's terms as well as these. Refunds are handled by Apple or Google under their policies; we cannot issue them ourselves. Pro is tied to the store account that bought it; on Apple devices, Universal Purchase and Family Sharing apply. Prices may change for future purchases; a purchase already made is not affected.

On Apple devices your use of the app is also governed by Apple's standard End User Licence Agreement for licensed applications, at apple.com/legal/internet-services/itunes/dev/stdeula, except where these terms say otherwise.

5. The paint catalog

The bundled catalog of paints (brands, names, colours and barcodes) is provided for identifying products you may own. It is compiled from public information and may contain errors, gaps or discontinued products; colours shown on screen are approximations and no figure in it is a promise of availability or accuracy. Zenithal is an independent product and is not affiliated with, endorsed by, or sponsored by any miniature or paint manufacturer; all trade marks belong to their respective owners.

6. Acceptable use

Use the app lawfully. Do not attempt to interfere with it, work around a paid feature, or disrupt any service it connects to.

7. Intellectual property

The app, its name, its design and its content are owned by Trueframe Digital and protected by copyright and other rights. Your own records and photos remain yours. Units, paints, recipes and figures appearing in demonstration data or in marketing material are illustrative only.

8. No warranty

The app is provided “as is” and “as available”, without warranties of any kind, whether express or implied, to the fullest extent the law permits. We do not warrant that it will be uninterrupted or error-free, or that any catalog entry, colour match or cross-brand equivalent it displays is accurate, complete or current.

9. Limitation of liability

To the fullest extent permitted by law, Trueframe Digital is not liable for any indirect, incidental or consequential loss, or for lost data, lost records or lost photos. Nothing in these terms limits liability that cannot be limited by law. If you are a consumer, you keep all statutory rights available to you, including, in Australia, the guarantees under the Australian Consumer Law.

10. Apple App Store

These terms are between you and Trueframe Digital, not Apple. Apple has no obligation to provide support or maintenance for the app. Apple is not responsible for addressing any claim you or a third party makes about the app, including product-liability, regulatory or intellectual-property claims. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

11. Governing law

These terms are governed by the laws of Victoria, Australia, without regard to conflict-of-law rules, and subject to any consumer protections that apply where you live.

12. Changes

We may update these terms as the app develops. Changes will appear on this page with a new “last updated” date, and continuing to use the app after that means you accept them.
